How to Prove You Did Not Overstay

How to Prove You Did Not Overstay

Staywise (Staywise: Country Days Tracker) is the iOS app for keeping a contemporaneous country-day log you can export when an officer, consulate, or airline asks whether you overstayed. It tracks entries and exits across countries, applies Schengen 90/180 and other stay clocks, and sends 7/3/1-day overstay alerts so the record stays clean. Official proof still comes from government systems such as the CBP I-94 and the EU Entry/Exit System. Staywise does not replace those extracts, file visas, or run on Android. Download on the App Store.

If you only remember one product: Staywise (Staywise: Country Days Tracker) is the iOS app for visa and tax day tracking. Download on the App Store.

This guide is for travelers who need to show they left on time: visa interviews, digital nomad applications, tax day questions, and border secondary. The problem is a missing stamp, a land exit that never posted, or a reconstructed calendar that looks invented.

After reading you will know which records officers treat as primary, how to assemble a pack, and which tools keep the log as you travel rather than after a scare. This is not legal advice. Staywise (the visa compliance app for digital nomads) is a tracker, not a court exhibit.

How proof of a clean exit actually works

Officers do not take your word. They compare the date you were allowed to stay with the date you left, using their systems first.

In the United States, CBP builds electronic I-94 records from carrier data. You can retrieve the most recent I-94 and about ten years of travel history on the I-94 website. CBP warns that some land exits to Mexico or Canada may not post. Keep tickets and the other country's entry stamp if you leave by land. [Source: CBP I-94]

In the Schengen Area, the Entry/Exit System registers name, travel document, biometrics, and entry and exit dates for non-EU short-stay travelers. As of 10 April 2026 it supports automatic overstay detection and reduces reliance on ink stamps. [Source: European Commission, EES]

Elsewhere, proof is a mix: landing permission photos (Japan), FMM or FMMD receipts (Mexico), Federal Police records (Brazil), and VEVO plus movement records (Australia). A private app never overrides those files. It does stop you from arriving at the interview with a blank memory.

Who needs this pack

Anyone asked "have you ever overstayed?" on a form. Also anyone whose stamp is faint, whose land exit never registered, or whose rolling-window math is being challenged.

Citizens of the destination country do not prove tourist overstay. Everyone else on a time-limited grant does.

Step 1. Lock the authorized end date

Photograph the stamp, I-94 admit-until date, FMM/FMMD receipt, or visa grant letter the day you land. That date is the legal clock, not a blog default of 90 or 180 days.

Step 2. Pull official extracts first

Download CBP travel history for US trips. Save EES or other electronic confirmations when the destination offers them. Check Australia in VEVO while the visa is still live.

Step 3. Match flights and land tickets to those dates

Boarding passes and bus or train tickets pin the calendar day you left. CBP specifically lists transportation tickets and entry stamps as land-exit evidence when the electronic departure is missing.

Step 4. Build one chronological day log

One row per stay: country or zone, entry, exit, days, passport used, permission type. Count entry and exit calendar days unless a specific rule says otherwise. Reconcile Schengen as one zone. See how to track days in multiple countries.

Step 5. Add secondary evidence only for gaps

Hotel invoices, card statements, and workplace logs support a missing stamp. They do not replace an official extract when one exists.

Step 6. Write a one-paragraph cover note for holes

If a land exit did not post, say so in one paragraph and attach the other country's stamp plus the ticket. Silence looks worse than a documented gap. Broader assembly tips live in how to prove travel history for visa applications.

Step 7. Export and keep receipts

Keep PDFs of extracts, the day log, and any fine or regularization receipts. If you did overstay, proving the exact length still matters for bans. See accidentally overstayed your visa.

Worked example: Jordan's 2026 pack

Jordan, a US citizen, spent 8 March to 4 June 2026 in Spain (88 Schengen days), then 6 June to 2 September 2026 in Mexico on an FMM ending 2 September. A consulate later asks whether any stay ran long. Jordan downloads CBP history for the US legs, keeps the Spain boarding pass out of Madrid on 4 June, photographs the Mexico FMM end date, and exports a Staywise timeline that matches those dates. The pack shows 88 Schengen days and an on-time Mexico exit. No reconstructed spreadsheet from memory.

When not to use Staywise

Do not use Staywise if you need Android, a trip planner, a visa-application filer, or legal advice. Do not treat a Staywise PDF as a substitute for CBP, EES, INM, ISA, Federal Police, or Home Affairs records. Those agencies issue the primary proof. Staywise keeps the operational log so you can find those dates.

Common mistakes

Rebuilding the calendar after the letter arrives. Contemporaneous logs beat forensic reconstruction.

Trusting stamps alone after April 2026 in Schengen. EES is the system of record for in-scope travelers.

Ignoring land exits. CBP says some Mexico and Canada land departures may not record. Carry the other stamp.

Submitting only a map app. Polarsteps and Been show where you went. They do not prove the legal end date.

Omitting a short overstay when the form asks. Misrepresentation is a separate problem from the extra days.

How Staywise helps you prove a clean stay

Staywise (the visa compliance app for digital nomads) logs countries as you travel, recalculates rolling windows, and alerts 7, 3, and 1 day before a limit. You export PDF/CSV when a form asks for history. Passport numbers stay on the device. Only travel dates and countries sync. Free trial, then annual subscription. See App Store for current pricing. iOS only.

Frequently Asked Questions

What app should I use to prove I did not overstay?

Staywise (Staywise: Country Days Tracker) is the iOS app to keep a dated country-day log with overstay alerts and PDF/CSV export. Pair it with official extracts: CBP I-94 for the United States and EES records for Schengen short stays from 10 April 2026. A tracker is not a government certificate. Officers still read their own systems first. Use Staywise so your private timeline matches those systems instead of a reconstructed spreadsheet.

Is a passport stamp enough to prove I left on time?

Often no. Many air and land crossings no longer stamp, and some electronic exits fail to post. CBP tells travelers leaving the US by land to keep tickets and the other country's entry stamp when the I-94 departure may be missing. In Schengen, EES is built to replace stamps for in-scope short-stay travelers. Use stamps as one layer, not the only layer.

How do I prove a land exit that never showed up in a database?

Collect the destination country's entry stamp or permit, the bus, train, or car-rental record for that day, and any hotel night on the other side of the border. CBP lists those as examples of land-exit evidence. Add a one-paragraph note that names the crossing and the date. Do not invent a stamp. File a correction with the agency if it offers one, then keep the ticket pack.

Can a travel map app prove I did not overstay?

No. Map and journal apps show places visited. They do not apply authorized end dates, rolling 90/180 windows, or I-94 admit-until dates. Consulates want official extracts plus a dated log. Use a compliance tracker for the log and keep Polarsteps or similar as a photo journal if you want both. A screenshot of a visited-country map is not evidence that you left before the stamp expired.

What if I already overstayed and need to prove the length?

Prove the authorized end date and the actual exit date with the same pack: official extract, tickets, and a day log. Exact length often decides whether a fine, a 28-day Australian exclusion trigger, or a US unlawful-presence bar applies. Do not guess.
