Dubai Tax Residency: The 90-Day Rule

Dubai Tax Residency: The 90-Day Rule

There is no Dubai-only 90-day tax-residency shortcut that applies to every visitor. Tax residence is a United Arab Emirates federal status under Cabinet Decision No. 85 of 2022. A natural person is a UAE tax resident if any one of three tests is met: 183 days or more of physical presence in any consecutive 12 months; 90 days or more in that window plus UAE or GCC nationality or a valid UAE residence permit, plus a permanent place of residence or employment or business in the UAE; or usual or primary residence and the centre of financial and personal interests in the UAE. Partial days count. Days need not be consecutive. Ninety days alone, without the extra conditions, is not enough.

This guide is for Golden Visa holders, freezone freelancers, and remote workers who treat "90 days in Dubai" as a complete tax plan. It is not.

The problem is collapsing three federal tests into one emirate slogan. A tourist stamp is not a residence permit. No personal income tax also does not mean your home country accepts UAE residence without a Tax Residency Certificate.

After this post you can apply the 183-day path, the conditional 90-day path, and the centre-of-interests path to a 2026 year, and see what the Federal Tax Authority actually asks for.

How the UAE 90-day and 183-day tests work

Article 4 of Cabinet Decision 85 lists three alternative conditions for a natural person.

183 days. Physical presence in the State for 183 days or more in the relevant 12 consecutive months. No residence visa is required on the face of this limb. It is the clean presence test.

90 days with ties. Physical presence for 90 days or more in that 12-month window, and the person is a UAE national, holds a valid Residence Permit, or holds GCC nationality, and also has a Permanent Place of Residence in the State or carries on employment or Business in the State. Both layers are required. Ninety tourist days in hotels do not match this article.

Usual residence and centre of interests. Usual or primary place of residence and the centre of financial and personal interests in the State, or conditions the Minister sets. This path has no published day minimum.

Ministerial Decision No. 27 of 2023 adds the counting rules: a day is a calendar day; all days or parts of a day of presence count; the 183-day and 90-day totals need not be consecutive. A permanent place of residence need not be owned, but must be continuously available. [Source: MoF, 1 March 2023.]

Residence Permit in the Decision means a permit to reside or work. It excludes a temporary entry permit for tourism, sport, medical treatment, or similar short visits.

Dubai vs the UAE, and tax vs immigration

Dubai marketing talks about 90 days. The Decision talks about the State. Days in Abu Dhabi, Dubai, Sharjah, or another emirate all count toward the same federal totals.

The UAE has no federal personal income tax on ordinary employment income. Corporate tax is a separate system. Tax residency still matters for a Tax Residency Certificate (TRC), treaties, and foreign non-resident claims.

Immigration has its own clock. A UAE residence visa can be at risk if you remain outside too long (commonly about six consecutive months). That is visa maintenance, not Article 4. A Virtual Working Programme or freelance visa is still only a residence permit for the 90-day limb. It is not a TRC.

Worked example with 2026 dates

Mira, an Indian citizen, holds a Dubai Golden Visa and an Ejari tenancy on an apartment that stays available all year. She also invoices through a DMCC freelance permit.

From 1 June 2025 to 31 May 2026 she is in the UAE 120 days (June, September, December, January-February, and May). Partial arrival days all count.

  • 183-day path: fail (120 is under 183).
  • 90-day path: 120 is over 90; she has a valid Residence Permit; she has a permanent place of residence and carries on business. This limb can succeed.
  • Centre-of-interests path: possible on these facts, but the 90-day-plus-ties path is the cleaner file.

If Mira had the same 120 days on visit visas and hotels, the 90-day limb would fail. If she had only 85 UAE days, even with a Golden Visa and Ejari, it would also fail. The Decision says 90 days or more, not "about three months."

Who the 90-day path applies to

It applies to UAE nationals, GCC nationals, and valid UAE residence-permit holders who also have a continuously available home or UAE employment or business, and who can prove 90+ days in a chosen 12-month window. It does not apply to tourists or hotel-only stays. The 183-day path can apply to anyone physically present, but staying that long without a residence basis is an immigration problem. The FTA's TRC service card (updated August 2026) matches these cases: 183 days; 90 to 182 days with home or work proof; or primary residence and centre of interests. [Source: FTA, issuance of tax certificates.]

Step 1. Pick the 12-month window you will prove

The window is consecutive months, not "calendar 2026 only." A 1 July 2025 to 30 June 2026 window can succeed when each calendar year looks short. Align the window with the period you will put on a TRC application. The FTA issues certificates for a tax period or another 12-month period that has started. It does not issue future-period certificates.

Step 2. Count every part-day from the entry/exit report

Use the official entry and exit report from the Federal Authority for Identity, Citizenship, Customs and Port Security (or the competent local entity). Count arrival and departure. Do not drop same-day connections if you were in the State.

Step 3. Match the extra 90-day documents

If you are on 90 to 182 days, the FTA asks for Emirates ID and passport with the entry/exit report, plus proof of UAE employment or business or a permanent place of residence. A tourist file will not do.

Step 4. Separate TRC, corporate tax, and home-country tax

A TRC documents UAE tax residence. It does not create it. US citizens still file with the IRS. Corporate tax is a different question from personal Article 4.

How to track UAE 90-day and 183-day clocks

The rolling 12-month window and part-day counting are where notebooks fail. Staywise (the visa compliance app for digital nomads) tracks UAE days toward both thresholds, plus 7/3/1-day alerts and residency-maintenance reminders. Passport details stay on your device. Available on iOS.

Common mistakes travelers make

Thinking 90 days in Dubai is enough for anyone. Without nationality or a residence permit, plus a home or job/business, 90 days is not Article 4(3).

Counting only Dubai and ignoring other emirates. The State is the UAE.

Using a visit visa as a Residence Permit. Temporary tourism entry is excluded.

Treating no personal income tax as "no tax residency." Home countries and treaties still need a residence analysis and often a TRC.

Using a calendar year when the statute uses 12 consecutive months, or mixing the six-month visa-absence rule with the 90-day tax path.

How UAE residence interacts with other countries

A UAE TRC is often what a foreign tax authority wants. It does not automatically break UK statutory residence, German Wohnsitz, or French foyer. Those systems look at homes and ties you kept. See does a digital nomad visa make you a tax resident?. If the UAE and another country both claim you, the treaty residence article controls treaty benefits.

Frequently Asked Questions

Is there a Dubai 90-day tax residency rule?

There is a UAE federal 90-day path, not a Dubai-only rule. Cabinet Decision No. 85 of 2022 treats you as a tax resident at 90 days in 12 consecutive months only if you are a UAE or GCC national or hold a valid UAE residence permit, and you also have a permanent place of residence or employment or business in the UAE. Ninety tourist days do not qualify. The unconditional presence test is 183 days.

Do I need 183 days in the UAE if I have a Golden Visa?

Not necessarily. A valid residence permit is one of the gates to the 90-day path. You still need 90 or more days in a 12-month window and a permanent home or UAE employment or business. If you cannot meet those extras, the 183-day path remains available. A Golden Visa without the day count and the home or work facts is not, by itself, tax residence.

Do partial days count toward UAE tax residency?

Yes. Ministerial Decision No. 27 of 2023 counts all days or parts of a day of physical presence toward both the 183-day and 90-day totals. Days do not need to be consecutive. An arrival at 11pm still counts. A same-day connection that remains in the State still counts. Build your total from the official entry/exit report, not from nights in a hotel.

Does UAE tax residency mean I pay personal income tax in Dubai?

The UAE does not impose a federal personal income tax on typical employment income. Tax residency is still a legal status used for Tax Residency Certificates, treaties, and foreign non-resident claims. Corporate tax can apply to businesses. Your origin country may still tax you on worldwide income. Do not equate no UAE PIT with no tax obligations anywhere, especially if you are a US citizen.

Can I get a Tax Residency Certificate on the 90-day path?

Yes, if the FTA is satisfied that you meet Cabinet Decision 85, read with Ministerial Decision 27. For 90 to 182 days the published document list includes Emirates ID, passport, an official entry/exit report, and proof of UAE employment or business or a permanent place of residence. Processing times and fees are set on the FTA service card. A certificate documents residence. It does not replace home-country advice.
